Heard both sides.

The present applicants, who are arrested by Gangapur Police Station, District Aurangabad in Crime No. I-280/2014, registered for the offences punishable under section 399, 402 of the I.P. Code, are praying for their release on bail.

The present applicants' earlier application bearing Criminal Application No. 6303/2014 was allowed to be withdrawn by this Court vide order dated 11.12.2014 with liberty to file similar application after filing of the chargesheet. Since the applicants' next of the application is dismissed after filing of the chargesheet, the present application.

The complaint of the ASI would show that in the night time at about 1.15 a.m., on information, they found the present applicants alongwith other youth gathering near a road with sickle, rope, a wooden club and chilly powder, etc. Therefore, the offence came to be registered.

Upon a query, the learned A.P.P. fairly submits that no other crime is registered against the present applicants. The applicants were arrested on 02.11.2014. The trial may take its own time. In the circumstances, the applicants can very well be released on bail. Hence, the following order:- 6.
All the present five applicants be released on bail in Crime No. I-280/2014, registered with Gangapur Police Station, District Aurangabad, for the offences punishable under section 399, 402 of the I.P. Code, on their executing P.R. bond in the sum of Rs. 20,000/- (rupees twenty thousand) each and also upon furnishing surety each in the like amount.

The present application accordingly stands allowed and disposed of.
