Heard both sides. Learned counsel for the respondent insurer submits that there is breach of terms and conditions of the policy on the ground that the driver of vehicle involved in the accident was not holding valid and effective driving licence to drive the vehicle container.

Learned counsel for the applicant submits that the applicant Is third party and accident had taken place when he was standing on the road.

In view of above, the applicant is permitted to withdraw an amount of Rs.6,00,000/- (Rupees Six lacs only) on furnishing undertaking to the satisfaction of Registrar (Judicial) of this Court. Civil application is accordingly disposed of. ( V. K. JADHAV, J.) rlj/
