The application impleading daughter to a suit for partition came to be granted by the order below Exh.36 in Regular Civil Suit No.32 of 2010, passed by the Civil Judge, Junior Division, Karjat, which is questioned herein.

Heard learned Counsel for the petitioner at length. According to him, the application is moved with an intention to delay the proceedings.

In my opinion, the said aspect cannot be gone into at this stage, particularly in the background that the suit is for partition, right and share of the married daughter to the property is already described in law.

In view thereof no case for interference is made out. As such, Writ Petition stands dismissed.
