Heard learned Counsel for the applicants/appellants. The learned Counsel for the respondent remained absent. He was also absent on last occasion.

However, the appeal is of the year 1998 which is too old. Learned Counsel for the applicants undertakes to supply substantial questions of law separately. In view of the same and considering old nature of appeal, the application stands allowed in terms of prayer clause (B) subject to cost of Rs. 2,000/- to be paid to the Library, Advocates Association of High Court Bombay, at Aurangabad.

Appeal be restored at its original stage after deposit of cost.
