1] The learned counsel for the respondent no.1 - employee tendered an affidavit wherein he has given up his claim for the back-wages from the management. The learned counsel further submits that the management to forward the proposal for release his back wages to the Education Officer and in case the Education Officer accepts the same and accordingly releases the back wages in favour of the respondent no.1 - employee, the employee will accept the same and in case the Education Officer does not

3335.22WP accept the proposal and does not release the back wages in favour of the employee, the employee undertakes that he will not claim any back wages from the petitioner management and will waive the back wages qua the management.

2] In view of the above affidavit, the petitioner - management has accepted the same and the employee is taken back in service.

3] In view of the above, the learned counsel for the respondent no.1 is permitted to file the affidavit tendered today in the registry within a period of two weeks from today.

4] In view of the above, the Writ Petition is disposed of with above observation.
