DATED : 27th March, 2015 PER COURT :- 1] Heard Shri R.S.Dhamangaonkar, learned counsel for the applicant and the learned Additional Public Prosecutor Shri M.M.Nerlikar for State. Leave to correct granted. 2] This is an application for anticipatory bail. By the present application, the applicant is apprehending his arrest 3] The first information report is lodged by one Sanjay Laxman Mantri against Ravindra Deshmukh, Sow. Vasudha Deshmukh and Shrirang Jagtap, the Directors of one Aryrup Tourism and Club Resort Pvt. Ltd. Mumbai. In the first information report, there are no allegations against the present applicant nor his name appears in the first information report. It appears that during the course of investigation, statement of one Jaichand Hirachand Khona is recorded in which he has stated that on behalf of Hemant Adalkar and Pawan Adalkar he has given amount to the present applicant, and therefore, the police are after him. 4] Curious to note that Hemant Adalkar and Pawan Adalkar have not approached to the police nor they have filed
crap844.15 any complaint against the present applicant. In that view of the matter, apprehension entertained by the present applicant is well founded and he is required to be protected. Hence, I pass following order.
O R D E R
(i) Criminal Application is allowed.
(ii) Applicant, in the event of his arrest, in connection with Crime No. 199 of 2010, registered with New Mondha police station, District Parbhani, for the offences punishable under Sections 420, 406, 467, 471/34 of the Indian Penal Code and under Section 3 and 4 of M.P.I.D. Act, be released on anticipatory bail on he executing P.R. Bond of Rs.5,000/- with one solvent surety in the like amount.
(iii) Criminal Application is disposed of.
