It is not disputed before this Court that petitioner has filed Regular Civil Suit No.69 of 2013 impugning the sale deeds in favour of contesting respondent nos.8 to 10. The suit was initially decreed and on the basis of that, Mutation Entry No.898 was recorded. However, in appeal filed by defendants, interim stay was granted and ultimately the appeal is allowed and matter is remanded back to Trial Court. In that view of matter, the very basis of Mutation Entry No.898 does not survive. In that view of matter, the impugned order passed by Chief Secretary dated 21.10.2024 cannot be faulted with. It is made clear that the rights of parties shall be governed by ultimate outcome of Regular Civil Suit No.69 of 2012. 3.
