This is an application for condonation of delay that is caused in filing appeal against conviction. Vide order dated 15.11.2022 passed by the learned Sessions Judge, Aurangabad, both the applicants are convicted for the offence punishable under Section 294 read with 34 of the Indian Penal Code. Both the applicants are given benefit under Section 4(1) of the Probation of Offenders Act, 195 and have been immediately released on probation of good conduct.

Considering that the delay is only of 26 days and for the reasons recorded in the application, this Court finds that a case is made out to condone the delay. Thus, the application is allowed and the delay is condoned.
