Leave to add the Block Development Officer, Panchayat Samiti, Omerga as respondent No.8. Addition be carried out forthwith. 2.

The only grievance of the Petitioner, who is a 75 years old agriculturist from village Kaldeo Nimbala, Omerga, is that he had made a representation to the Deputy CEO, Zilla Parishad, Osmanabad on 19th November, 2015 which is kept pending. The Deputy CEO advised the BDO, Panchayat Samiti, Omerga vide communication dated 3rd December, 2015, to consider the application and initiate steps and tender a report. No such report has been tendered despite several representations by the Petitioner.

In view of the above, this Writ Petition is disposed off with a direction to the BDO to comply with the communication from the Deputy CEO dated 3rd December, 2015, within a period of 90 days, if not already complied with and if there is no legal impediment. In the event, he has already dealt with the said application, a communication shall be addressed forthwith to the Petitioner to appraise him of the further development that have taken place pursuant to the said communication dated 3rd December, 2015.
