The petitioner is before us seeking to participate in the selection process through second round of TAIT 2022 process being undertaken by the respondent Nos. 2 and 3.

It is being pointed out that though the petitioner has been permanently debarred from appearing at the TET examination for the alleged scam, she was having the requisite qualification of C-TET as prescribed under Rule 6 of the Maharashtra Employees Of Private Schools (Conditions Of Service) Rules, 1981 read together with Rule

2925.25wp (2) 2(1)(e-1) wherein TET has been defined, inter alia, to mean even the C-TET.

The learned advocate appearing for the respondent No.2 for want of concrete instructions is unable to make any statement as to if the petitioner can participate in selection process through second round of TAIT 2022.

We dispose of the writ petition with a direction to respondent No. 2/Maharashtra State Council of Examination to permit the petitioner to participate in selection process through TAIT 2022 on the basis of her C-TET qualification, in the selection process through second round of TAIT 2022, if there is no legal impediment which enables the respondent No. 2 to prevent her, except on the ground that her TET performance has been cancelled and she has been debarred.
