PER COURT :

1. The learned counsel for applicant submitted that police have filed 'B' summary report, but no order is made by the learned J.M.F.C. on the report. So, he requested for time. It is not certain as to how much time will be required to Magistrate to take decision of the said report and so, the present matter cannot be kept pending.

2. Present matter is disposed of as premature. If Magistrate refuses to accept 'B' summary report and further investigation is directed, then there will be liberty to the applicant to approach this Court again. In those terms the application is disposed of.
