On 31.08.2019, this Court had passed the following order :- "1.

Shri Suryawanshi, learned Advocate for respondent No.1 University submits that this petition pertains to the claim of the petitioner for admission to the B.Ed. Course in 2002 which was denied. This matter is, therefore, rendered infructuous.

The learned AGP submits that the Advocate representing the petitioner has passed away.

In view of the above, issue notice for final hearing to the petitioner, returnable on 26/09/2019. This matter would be taken up after the fresh admission board is over."

Earlier, this Court had passed the following order on 04.11.2003:- "The State Government is directed to file an affidavit clarifying as to whether Diploma "Alima" of

*2* 938wp2145o03 Jamatus Salehat from Malegaon District has been granted equivalence with B.A. Degree Course, for the purpose of admission to B.Ed. course. The University has already passed a resolution granting equivalence to the said Diploma (as equivalent with B.A. Degree) for the purpose of admission to B.Ed. so also M.A. course. Shri Jaju, AGP waives service for respondent No.2. S.O. two weeks."

The learned advocate for respondent no.1/ university submits that equivalence was granted to "Diploma of Alima" from Jameatus Swalehat, Malegaon and no equivalence was granted to "Diploma in Aalemmiya" from the said Jameatus Swalehat, Malegaon. Despite issuance of notice by this Court on 31.08.2019, the petitioner could not be served as the bailiff report indicates that she is not found on the said address.

In view of the above, this Writ Petition is dismissed in default. Rule is discharged.
