The proposal seeking correction in date of birth of the petitioner in school record is rejected by the Education Officer on the ground that the petitioner has left the school.

The full bench of this Court in case of Janabai Himmatrao Thakur Vs. The State of Maharashtra and others reported in 2019 (6) Mh.L.J. 769 has observed that in case of obvious mistakes the application for correction can be entertained, even if the student has left the school.

It appears that in the school record of the 4th Standard the date of birth is mentioned as 04.05.1991. Subsequently, same mistake has occurred.

In light of the above, the impugned order is quashed and set aside. The Education Officer shall re-consider the proposal for correction of date of birth and if the Education Officer comes to the conclusion that there is obvious mistake, then may consider and decide the application on its own merits.

Writ Petition accordingly stands disposed of. No costs.
