This application is filed seeking condonation of 40 days' delay in filing appeal against the judgment and award dated 29th October 2018 passed by the Commissioner for Workmen's Compensation, Jalna, in Employee's Compensation petition No. 4/2017.

Heard learned Counsel for the applicant-appellant and the learned Counsel representing respondents No. 1 to 5-claimants. Respondent No. 6 is reported to have not contested the claim before

Considering the submissions advanced and taking into consideration the delay of 40 days caused in filing appeal, the application is allowed in terms of prayer clause (B). Delay is condoned. The appeal be registered and place for admission on 19th June 2019.

Mr. V.B. Kulkarni, learned Counsel waives notice for respondents No.1 to 5. Notice be issued to respondent No.6, returnable on 19th June 2019.
