By this application, the applicant (original petitioner) is seeking restoration of the writ petition which stood dismissed in terms of the order dated 28.02.2022, which was a conditional order for removal of office objections, failing which the petition was to be dismissed without reference to the court.

We have considered the contents the application. Although there is a huge delay of 1034 days in filing the application for restoration, it is stated that the website of this court was showing the status of the writ petition as pre-admission, leading to confusion in the mind of the counsel representing the petitioner with regard to the actual status of the petition. It was believed that the petition was pending and when circulation was sought, it came to light that the petition was already dismissed in terms of the order dated 28.02.2022.

We are of the opinion that although a semblance of reason is given in the application, yet the petitioner is expected to be vigilant and to follow up the status of the petition, as the order dated 28.02.2022 passed in the writ petition was also available on the website of this court.

Hence, we are inclined to impose appropriate conditions before allowing the present application.

In view of the above, the application is allowed. Delay is condoned and the writ petition is restored subject to the petitioner removing the office objections within two weeks from today and also subject to costs of Rs. 2500/- being deposited with the Creche/Day Care Centre, Advocates' Association of Bombay High Court, Bench at Aurangabad within the said period.

If the petition is restored upon compliance of the above conditions, it shall be listed before this Court within two weeks of restoration.
