Mr. Bagul, learned counsel for the petitioner submits that the post of Sarpanch for Grampanchayat Vardi, Taluka Chopda, District Jalgaon is reserved for General category. The petitioner belongs to SC category. The said post ought to have been reserved for SC category. The said post of Sarpanch was never reserved for SC category since the year 1995. This time it ought to have been reserved for SC category. The same is reserved for General category for the third time since 1995. 2.

The population of SC category of the present Grampanchayat is less than 4%. We do not find statistics and the ratio of population in other villages where the post has been reserved for SC category. In
