The caste claim of the Petitioner as Thakur, Scheduled Tribe is invalidated.

The learned Counsel for the Petitioner submits that the father of the Petitioner is issued with the Validity Certificate under the orders of this Court dated 05.08.2003 in Writ Petition No. 1875 of 2003. The learned Counsel submits that all the entries in the school record of the paternal relatives of the Petitioner record caste as Thakur. The learned Counsel submits that only one contra entry is shown in the record

2 wp 2527.2022 of the second degree cousin of the Petitioner Babashaeb Bhika Suryawanshi of the year-1990, however all the earlier entries and subsequent entries record caste as Thakur of the paternal relatives of the Petitioner.

Mr. Patil, the learned A.G.P. submits that there are two invalidation in the family of the Petitioner in November-2021.

The learned Counsel for the Petitioner submits that they have challenged the same and this Court has issued notice in the Writ Petitions filed by them.

The learned A.G.P. submits that the Petitioner failed in the affinity test. The occupation has been found to be of Bhikshuki, the same is of Bhat persons. According to the learned A.G.P. Show cause notices are also issued to the validity holders relied by the Petitioner.

Only one document of the year-1990 in the school record of Babasaheb Bhika Suryawanshi records caste as Hindu Maratha and in all the school record of the paternal relatives of the Petitioner the caste is recorded as Thakur.

The father of the Petitioner had already applied for the issuance of Validity Certificate of Thakur, Scheduled Tribe. The claim was invalidated. He filed Writ Petition No. 1875 of 2003. The Division Bench of this Court under Judgment and Order dated 05.08.2003 allowed the Writ Petition and directed the Committee to issue Validity Certificate to him.

In the light of aforesaid facts, we pass the following orderORDER [I] The impugned order is quashed and set aside.

[II] The Committee shall issue Validity Certificate to the Petitioner of Thakur, Scheduled Tribe.

[III] In case, the Judgment of the Division Bench of this Court dated 05.08.2003 passed in Writ Petition No. 1875 of 2003 is

The Writ Petition accordingly stands disposed of. No costs.
