Since the program of election has come to an end, instant petition is rendered infructuous. An affidavit-in-reply has been presented on behalf of respondent whereunder it is stated that only 13 nominations were received for 13 seats and as such all the eligible candidates who presented nomination, including petitioner, are entitled to be declared elected. Petitioner also contends that no steps have been taken for bifurcation of the co-operative society, Ladzari into different societies. However, there is no relief claimed in the writ petition in respect of division of co-operative society. Apart from this, there appears to be opposition from said society i.e. Co-operative Society, Ladzari, for bifurcation. Petitioner is also one of the proposed elected members of the newly elected managing committee of the society. It would be open for the petitioner to take appropriate steps for
wp1939.15.doc bifurcation of the society and approach District Registrar of the Co-operative Society for redressal of his grievance. With liberty as aforesaid, writ petition stands disposed of.
