We have heard both the sides.

The learned A.P.P., on instructions from the Investigating Officer, who is present in person in the Court submits that the Investigating Officer is going to submit 'B' summary report, which is ready with him before the trial Court. 3.

In view of the same, the petitioner would be at liberty to file the protest application before the Magistrate and upon filing of such protest application, it is for the Magistrate either to accept the 'B' summary report or considering the protest application, to issue suitable directions for further investigation in connection with the present crime.
