We have heard Mr. Jadhavar, learned Counsel for the petitioner.

According to the learned Counsel, the proposal of the petitioner for academic year 20192020 was recommended by respondent no. 2. The same was not rejected by the State Government on merits. Only because Letter of Intent was issued to another college the proposal of the petitioner was not considered. In view of that, for the current academic year the petitioner's proposal be considered and the petitioner may not be made liable for payment of process fees afresh or the

2 wp 5638.2021 respondent be directed to refund the process fees paid by the petitioner for the academic year 20192020. 3.

For the academic year 2019-2020 the proposal of the petitioner is not considered by the State Government as Letter of Intent for the same location was issued to another Institution. In view of that, it was axiomatic rejection of the proposal of the petitioner.

The petitioner has filed fresh proposal for the academic year 2021-2022, naturally the petitioner will have to pay fees for that and if the petitioner has filed proposal along with the fees certainly the same shall be considered by the respondents on it's own merits, in accordance with law and as per the stipulations laid down under the Maharashtra Universities Act.

Writ Petition is accordingly disposed of. No costs.
