Mr. M.K. Deshpande, Advocate for the applicants Mr. L.V. Sangit, Advocate for the respondent Nos.1A and 1B ...

CORAM :

SMT. VIBHA KANKANWADI, J.

DATE :

13th MARCH, 2019 PER COURT :

Present application has been filed to condone the delay caused in bringing the legal representatives of the sole appellant on record, so also to bring them on record.

It is stated that the sole appellant expired on 11.10.2017. However, his legal representatives were not aware about the proceedings, which were filed by him and therefore, there is delay of 66 days. It is stated that the delay is unintentional.

The application has been strongly objected, on the ground that

CA_4541_2018 the delay of 66 days has not been properly explained. Taking into consideration the fact that the appeal was filed way back in the year 2005 and it was long back admitted and the fact that the legal representatives of the appellant were not aware about the proceedings. Delay appears to be unintentional and therefore, deserves to be condoned. Hence, it is condoned.

The legal representatives be brought on record within 14 days from the date of this order.
