This matter was heard briefly and considering the conspectus and the statement of the petitioner that he is willing to accept the promotion and report to the Government Medical College and Hospital at Dhule, we had called upon the learned AGP to take instructions as to whether the post of Professor Preventive and Social Medicine is vacant at the Government Medical College and Hospital, Dhule. The learned AGP submits, upon receiving a communication from the Under Secretary, State of Maharashtra, Medical Education and Drugs, dated 20.02.2023 (informing him) that the said post is vacant at Dhule.

In view of the above, this petition is disposed off. Considering the order of promotion and posting dated 11.08.2022, the petitioner would be at liberty to report accordingly on 01.03.2023.

In view of the above and the statement of the petitioner, Clause 16 (ii) and (iii) of the impugned judgment dated 07.02.2023 delivered by the learned Maharashtra Administrative Tribunal in O.A. No.1088/2022, would lose its efficacy.
