IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 909 WRIT PETITION NO.2317 OF 2005 BHARADE SAKSHARATA PRASARAK MANDAL & ORS.

VERSUS

THE STATE OF MAHARASHTRA AND ORS.

.....

Advocate for Petitioners : Mr. B V Wagh (absent) AGP for Respondents: Mr. A.S. Shinde .....

CORAM : V. K. JADHAV, J.

DATED : 22nd JANUARY, 2020 PER COURT:- 1.

None present for the petitioners. It is informed by the learned counsel present in the court that advocate Mr. B.V. Wagh, who is representing the petitioners, is selected and appointed as District Judge and presently he is in judicial service. However, this writ petition has been preferred against the order passed by the Adhoc Additional District Judge, Ahmednagar on 22.02.2005 in Misc. Civil Appeal No. 4 of 2005 allowing thereby the production of the documents in the appeal. 2.

By order dated 5.4.2005, while granting Rule, the effect of the order passed by the Adhoc Additional District Judge, Ahmednagar dated 22.02.2005 passed in the said Misc. Civil Appeal has been stayed. However, the learned District Judge was directed to proceed to hear the appeal as it is. As per the office note, the suit itself is disposed of on 8.1.2007 by the trial court. In view of the same, nothing survives in this writ petition and even no purpose would be served by issuing notice to the petitioners as the same would be futile exercise.

wp2317.05 -23.

In view of above, this writ petition has become infructuous. The writ petition is hereby dismissed. Rule discharged. ( V. K. JADHAV, J.) rlj/
