The learned counsel for the petitioner states that, the amount of gratuity, interest and pension is not released. For six months provisional pension was paid to the petitioner. However, thereafter it was stopped only on the ground that, the writ petition was filed by the institution against the order of School Tribunal and same is pending in this Court. In the said writ petition also interim relief is specifically refused. 2.

The learned Additional Government Pleader states that, proposal is already forwarded to the respondent No. 1 by the Education Officer for sanction of retiral benefits that is regular

In the light of the above, we pass the following order. 4.

The respondent No. 1 shall take decision on the said proposal received by it with regard to pensionary and retiral benefits of the petitioner as forwarded by the Education Officer expeditiously and preferably within a period of four (4) months from today and if found eligible shall release the same within a period of two (2) months thereafter.
