Heard learned counsel for both sides. They submitted that the matter was referred to the Mediator and the settlement is made. Copy of the settlement order is placed on record. They requested to prepare the Award on the basis of settlement.

In view of this, First Appeal is allowed. The Judgment and Award passed by the Tribunal is modified. New Award is to be prepared on the basis of settlement. 3.

Learned counsel for appellant submitted that the amount of Rs. 25,000/- deposited for filing the appeal in this Court be adjusted in satisfaction of the Award.
