The challenge in this petition is to an order dated 03.02.2022 passed by the Special Executive Magistrate, Ahmednagar directing the applicant to execute bond in the sum of Rs.10,000/- under Section 107 of the Code of Criminal Procedure for a period of six months. Since it appears that it is clear that now the six month period is over, there was interim relief granted by this Court, while issuing notice by order dated 23.02.2022. Thereafter on several occasions, the matter was adjourned.

The learned APP however was never given instructions by the respondent and therefore no reply is filed. It would be suffice to say that the period mentioned in the notice has already expired and therefore it would be of no use to act upon the same communication. The same communication dated 03.02.2022 (page no. 41 to the petition) is therefore quashed and set aside. As such, the application stands disposed off.
