2] Heard the learned counsel for the applicant and respondents and perused the impugned judgment and order passed by the trial Court as well as copies of the depositions of the witnesses examined before the trial Court.

3] Upon considering submissions advanced in the light of impugned judgment and the copies of depositions placed on record, I am of the view that arguable case has been made out to be considered in appeal. I am therefore, inclined to allow the application

4] Appeal be registered and placed for admission on 24/4/2017. learned counsel for the respondents waives notice before admission of appeal.
