Mr. Patil, the learned counsel submits that, the award has been passed on 29.08.2012, but the entire amount under the award has not been paid. The petitioners have received Rs. 40,00,000/- out of total compensation awarded to them of Rs. 1,63,09,092/-.

The learned Assistant Government Pleader states that, the Executive Engineer Minor Irrigation Department, Jalgaon has been communicated to deposit the amount, however the amount is not deposited by the acquiring body and as such amount of

2 wp 2359.16 compensation is not paid to the petitioners. Even no reply is received from them.

Mrs. Kutti, the learned counsel appears for respondent Nos. 4 and 5.

We have heard the learned counsel for respective parties. 5.

Considering the fact that, award has been passed in the year 2012 and the petitioners are only paid a part amount of the said compensation, the respondents are required to deposit the remaining compensation amount expeditiously.

In the light of that, the respondents shall pay the remaining compensation amount to the petitioners as per the award dated 29.08.2012 expeditiously and preferably within a period of four (04) months from today. The writ petition is disposed of. No costs.
