8th FEBRUARY, 2018 PER COURT:- 1) On 29.1.2018, the First Appeals were ordered to be admitted because this Court was under the impression that the applications seeking condonation of delay have already been allowed as in case of one of the connected matters from this batch. However, it is pointed out that the applications for condonation of delay were pending as
( 2 ) on 29.1.2018. Accordingly, the order of admission of these appeals made on 29.1.2018 is hereby recalled. 2) Since, the Civil Application No.3804 of 2017 for condonation of delay filed in the connected matter i.e. in First Appeal Stamp No.4206 of 2017, has already been allowed and the delay is condoned on condition that the applicant will not be entitled to any statutory benefits or interest for the delayed period, for the same reasoning, and upon the same condition, the civil applications seeking condonation of delay in institution of these appeals are allowed. The civil applications for condonation of delay are disposed of.
3) Since, now the delay stands condoned and since the connected appeal is also admitted, even these appeals are admitted today.
4) Mr.B.V.Vride learned AGP waives service of notice on
( 3 ) behalf of respondent No.1 in all these matters. 5) The applicants in these applications to file undertakings within four weeks from today that they shall not claim any statutory benefits or interest for the delayed period in the event these appeals are allowed and compensation amount is ordered to be enhanced. Such undertakings to be filed within four weeks from today with copies to the learned counsel appearing for the respondents.
