This is an application for condonation of delay. Mr.Autade, the learned counsel submits that against the same award, the State has filed Appeal and the same is admitted. It is submitted that the applicant had suffered heart attack and was not in position to move for a quite ling time.

Learned AGP appears for respondents 1 to 3 and opposes the application 3.

For the reasons stated in the application and the bonafide shown by the applicant that the applicant would waive statutory benefit for the delayed period, the application is allowed. Delay condoned. Civil Application disposed of.
