Heard the learned counsel for the applicant and the learned A.P.P for the respondent/State.

The applicant is seeking relaxation of the said condition for the reason that there is no male member to look after his family. He is ready to undertake that he would not involve in the similar crime. There were no complaints against the applicant for breach of the condition not to enter the village as per the order of this Court.

In view of the facts if condition is relaxed no harm would be caused to the prosecution. Hence, the following order :-

ORDER

(I) Application is allowed.

(ii) Condition No. (iv) "Until conclusion of the trial, the applicant shall not enter village Jalgaon, Tq. Paithan, District Aurangabad", in bail application No.1222 of 2022, dated 12th September, 2022, is relaxed on the undertaking that applicant would not involve in the similar crime.

(iii) Applicant shall furnish the undertaking as above before the concerned Investigating Ofcer.
