DATED : 4th May, 2016.
ORDER :
1.
During speaking to minutes, the learned counsel for present respondent, original claimant submitted that the office has asked him to get the clarification of the order dated 23.2.2016.
2.
It appears that two vehicles were involved in the accident and the liability to pay the compensation is saddled on both Insurance Companies and each Insurance Company is directed to pay 50% of the total compensation amount. The appeal filed by the National Insurance Company, who is expected to pay 50% of compensation amount and it has deposited amount of Rs. 12,73,000/- (Twelve lakh seventy three thousand). This Court has made order of release of this entire
CA No. 2146/2016 amount in favour of applicants.
3.
This Court has asked to deposit the amount awarded to minors in fixed deposit in any nationalised bank. It is made clear that the amount deposited in this Court is only 50% amount and accordingly, the share of the minors is to be calculated and that amount is to be kept in fixed deposit. Similarly, the amount of Rs. 3,00,000/- (Rupees three lakh) was awarded to father of deceased, but only 50% amount with interest is deposited as only one Insurance Company has challenged the said decision. Accordingly, the share of father of deceased which is 50% of the amount of Rs. 3,00,000/- (Rupees three lakh) is involved in the matter and so that amount is to be released in favour of father of deceased.
4.
Motion is disposed of.
