Learned counsel for the applicant has pointed out that, in a companion matter, initially, the Division Bench of this Court has permitted the applicants therein to withdraw 50% of the amount on furnishing bank guaranty to the satisfaction of the Registrar and thereafter this Court has permitted the applicants to withdraw the remaining amount along with accrued interest thereon, on furnishing undertaking. Learned counsel appearing for the acquiring body has not disputed this position.

In view of the same, the applicant is permitted to withdraw remaining 50% of the amount along with accrued interest thereon on furnishing undertaking to the satisfaction of the Registrar (Judicial). Civil application is accordingly partly allowed and disposed of. ( V.K. JADHAV, J. ) vbd
