DATE : 17th February, 2025 Per Court :- The petitioner is claiming benefits of Assured Career Progression Scheme (ACPS) under various government resolutions.

We have heard both the sides i.e. the learned advocate for the petitioner and the learned AGP. 3.

The petitioner is an employee of respondent No.6 management in respondent No.7 school, which is private Ashram School receiving grant in aid.

Benefits of ACPS available to the Government

*2* 70wp2334o25 Ashram Schools have been held to be equally applicable to the employees of private aided Ashram Schools as held in the matter of Kiran Namdeo Shinde and others vs. The State of Maharashtra and others, Writ Petition No.2358/2013 and connected matters decided at the principal seat by common judgment and order dated 21.09.2013.

In the light of such admitted position, the Writ Petition is allowed. Respondent Nos.1 to 5 shall scrutinize the petitioner's case on its own merits under various schemes for Assured Career Progression. The decision shall be taken within twelve weeks and benefits to which she is found entitled to, shall be released within six weeks thereafter. However, arrears shall be restricted to the period of three years next before filing of the writ petition.
