Mr. S.K. Kadam, learned advocate appearing for respondent Nos. 1 / the State Cooperative Election Authority has placed on record the communication dated 22.2.2023 whereby a decision is taken by respondent No. 1 to defer the election process of the society and the process will be continued from the stage of decision on the objections which are already received.

The learned counsel for respondent No. 1 submits that no new objections will be entertained and the decision on the objections received on the provisional voters list will be rendered by the newly appointed Taluka Cooperative Election Officer, who would be appointed today. 3.

In view of the stand taken by respondent No. 1, the learned counsel for the petitioner seeks leave to withdraw the present writ petition as his grievance is already addressed. He further submits that in the event, the respondent No. 1 does not implement the communication dated 22.2.2023, the petitioner be granted liberty to re-agitate grievance raised in the

WP 1817/23 present writ petition.

In view of the above, the petitioner is permitted to withdraw the writ petition with liberty as above. It is clarified that in the event, the respondent No. 1 does not implement the communication dated 22.2.2023, the petitioner is at liberty to re-agitate his grievance raised in the present writ petition.
