Heard learned counsel for the applicant and learned APP for the State.

The FIR reveals that the injured and the deceased had been to the house of so-called assailant and the incident happened. The allegations against the present applicant were that he assaulted one of the injured namely Mahendra Nana Patil by sickle on head. His injury report shows that he has sustained simple injury. The alleged weapon used by the applicant has been recovered from another accused. Nothing is to be recovered from him. The charge sheet has also been filed.

Considering the role attributed to the applicant and the nature of injury, the Court is of the view that the applicant deserve bail. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Roshan Pundlik Patil, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with Crime No.205 of 2022, registered with Parola Police Station, District Jalgaon for the offence punishable under Section 302, 307, 326, 324, 323, 143, 147, 148, 149, 504, 506 of the Indian Penal Code and Section 4/25 of the Indian Arms Act, on the conditions that he shall not tamper with the prosecution witnesses.

(iii) The applicant shall stay away from his village for three months from the date of his release.
