Heard the learned counsel for the applicant and the learned APP for the respondent-State.

Perused the papers. The role attributed to the applicant is that he along with other co-accused assaulted the injured with a wooden rod. Wooden rod has been recovered. In PCR, nothing has been recovered from the applicant. Considering the role attributed to the applicant, the Court is of the view that his further detention would not serve the purpose. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

946-BA.306-23.odt (ii) Applicant AKASH BALU SHERE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.01 of 2023, registered by Police Station M.I.D.C. Waluj, District Aurangabad, for the offences punishable under Sections 307, 324, 504, 143, 147, 148 read with Section 149 of the IPC, on the following conditions :

(a) The applicant shall not tamper with the prosecution witnesses.

(b) He shall attend the Police Station as and when called by the Investigating Officer on written notice till filing of the charge sheet. (S. G. MEHARE, J.) ...
