Heard learned Counsel appearing on behalf of the petitioner. 2.

A limited grievance is raised in the petition. Learned Counsel for the petitioner, by inviting our attention to the documents placed on record submitted that the petitioner had approached respondents-authorities raising the grievance about an encroachment made over open place. He then invited our attention to the communication dated 29th October, 2018, forwarded by the Deputy Chief Executive Officer, Zilla Parishad, Osmanabad to the Block Development Officer, Panchayat Samiti, Lohara to submit that the Deputy Chief Executive Officer directed the subordinate authority to conduct an inquiry in the matter and submit a self-speaking report.

He then submitted that the communication is also forwarded from the office of the Deputy Collector, Osmanabad to the Chief Executive Officer, Zilla Parishad, Osmanabad along with the complaint/application submitted by the petitioner and the Chief Executive Officer is informed to conduct a detail inquiry and submit inquiry report. As no action is taken in this application or in pursuance of the communication, the petitioner is before this Court is the further submission of learned Counsel for the petitioner.

In view of aforesaid limited grievance, we dispose of the petition at the admission state with directions to respondent No.3 - Chief Executive

(3) Officer, Zilla Parishad, Osmanabad to take appropriate steps so as to decide the application/representation dated 12th December, 2018 of the petitioner, as expeditiously as possible and not later than ten weeks from the date of the order of this Court.

Authenticated copy of this order be supplied to the Counsel for respective parties.
