Petitioner is seeking initiation of action against respondents for committing wilful disobedience of the order passed by the Assistant Charity Commissioner on 31.01.2014. It is contended that contempt is in respect of clause (5) of the order restricting the managing board from taking any policy decision. Our attention is invited to resolution dated 14.01.2015 wherein one Shri Mali has been elected as Secretary in place of one A.M.Jain. This resolution was pointed out to us when Writ Petition No. 1065/2015 was taken by us for consideration. According to us, the decision taken by the managing body is not policy decision. This Court while considering writ petition thought it appropriate not to advert to the contentions raised by petitioner referring to the resolution in question. Even otherwise, the

cp92.15.doc decision taken by the managing body does not have any financial impact and as such no cognizance of the contempt petition be taken. Contempt petition stands rejected.
