The petitioner is aggrieved by the order dated 14th February, 2018, passed by the Returning Officer/ respondent No. 1, thereby rejecting the nomination form of the petitioner. Grievance is that the petitioner was not aware that he has been disqualified by an order dated 23/02/2016, passed by the District Collector, Aurangabad, on account of his failure to submit the accounts of election expenses.

Learned AGP and Shri Shelke, learned counsel appearing for the Election Commission submit that as on date of the rejection of the petitioner's nomination paper, his disqualification by order dated 22/02/2016 for

the period of five years, stands as the petitioner has not challenged the said judgment.

considering the above, this petition being devoid of merit, is therefore, dismissed.
