IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD CONTEMPT PETITION NO.217 OF 2017 IN WRIT PETITION NO. 11204 OF 2016 SKYS Sugars PETITIONER
VERSUS
Shri V. D. Shevade RESPONDENT .......
Mr. N. D. Batule, AGP for Respondent - State .......
[CORAM : NITIN B. SURYAWANSHI, & VAISHALI PATIL-JADHAV, J. J.] DATE : 28 th NOVEMBER, 2025 ORDER :
1.
By order dated 16th November, 2016, passed in Writ Petition No.11204 of 2016, this Court directed Respondent No.1 to take decision on the Application of the Petitioner dated 26th June, 2016, within four weeks.
2.
Present Contempt Petition is filed on 16th February, 2017. However, the record shows that when the matter came up before this Court on 17th March, 2017, none appeared for the Petitioner and the matter was adjourned. Thereafter, from time to time, the matter was adjourned, however, no formal notice was issued to the Respondent. On 3rd October, 2025, notice was issued to
{2} cp217-17.doc the Respondent and it was made returnable on 7th November, 2025. The bailiff report shows that the Petitioner's shop is sold before 5 years and whereabouts of the Petitioner are not known. 3.
It appears that due to passage of time, the Petitioner seems to have lost interest in the present Contempt Petition. By this time, the order must have been complied with and, therefore, the Petitioner did not prosecute the Contempt Petition. 4.
The Contempt Petition is, therefore, disposed of for want of prosecution.
