PER COURT:- 1.

The petitioner had filed an appeal under Section 247 of the Maharashtra Land Revenue Code, 1966 along with an application for condonation of delay before the District Superintendent of Land Records. The same is rejected.

If the matter is filed under Section 247 of the Maharashtra Land Revenue Code, then the petitioner has remedy of Revision under Section 257 of the Maharashtra Land Revenue Code before the Divisional Commissioner. 3.

If the proceedings were filed under Section 32 of the Maharashtra Prevention of Fragmentation and consolidation of Holdings Act (for short said Act) then the petitioner has remedy under Section 35 of the said Act before the State Government.

In view of the above, we are not inclined to entertain the Writ Petition. Writ Petition, as such is disposed of. The petitioner may avail the remedy as is permissible in law. No costs.
