The learned A.G.P. seeks time to file reply.

None appears for respondents no. 3 to 5, though served.

Earlier also, the petitioner was declared as surplus and had approached this Court by filing Writ Petition No. 11273 of 2018. The petitioner had made representation pointing out that the petitioner cannot be declared as surplus. This Court under order dated 16.10.2018 in Writ Petition No. 11273 of 2018, directed the Education

2 wp 2221.19 Officer to decide the representation filed by the petitioner within six (06) weeks. It is submitted that the representation is not yet decided and again the petitioner is declared surplus by the Headmaster on 10.12.2018. The grievance raised by the petitioner, that, he cannot be declared surplus is not being considered by the authorities.

The petitioner shall file a fresh application with the Education Officer (respondent no. 2) putting-forth his grievance with regard to he being declared surplus. The Education Officer (respondent no. 2) shall decide the grievance / representation of the petitioner within a period of eight (08) weeks of the receipt of the same. 4.

Writ Petition stands disposed of accordingly. No costs.
