The challenge in the petition is to the clauses in the E-tender notice dated 5th December, 2020 which is pertaining to the development Wayside amenities of Nagpur-Mumbai Super Communication Expressway. 3.

The learned counsel Mr. Adwant for respondent No.2, on instructions, submits that pursuant to the tender notice, bids were received, opened and after having process the same, the same are to be placed before the Board of Directors of respondent no.2.

In the aforesaid background, what can be noticed is tender process has travelled at an advance stage and considering the nature of claim made in the petition, the contractual rights which the petitioner is claiming, it will be inappropriate for us to cause interference in the aforesaid matter. The petition as such stands dismissed.
