The averments made in the application are not controverted. 4.

Learned Counsel for the applicants, on instructions makes a statement that in case the enhancement is granted to the applicants, in appeal, they will not claim statutory benefits for the delayed period. 5.

For the reasons stated in the applications, applications are allowed with a rider that in case the enhancement is granted to the applicants in appeal, they would be not entitled for the statutory benefits for the delayed period.
