This matter is called out at the end of the board, since a pass over was sought on behalf of the learned Advocate for the Petitioner to take instructions.

He now submits that the Petitioner would deposit an amount of Rs.4,50,000/- on or before 01.03.2024 before Sub Divisional Officer. This would be without prejudice to his right of preferring an Appeal.

In view of the above, this Petition is disposed off. The auction sale scheduled today shall proceed further as per schedule. To the extent of the Petitioner, the auction sale of the JCB bearing Registration No. MH-41-T-1540, shall not be finalized until 01.03.2024, since the Petitioner would be depositing an amount of Rs.4,50,000/- before the Sub Divisional
