Ms. Talekar, learned counsel for the petitioner submits that the change report is pending with the respondent since one year, the same is not yet decided.

It appears that the petitioner has already made the application (Page No.108) for approval / acceptance of the change report. The said application, it appears, would be in tune with the amended provisions of Section 22 of the Maharashtra Public Trust Act. It is for

969-wp-5135-2021 the respondent to take the decision upon it within the stipulation as provided under Section 22 of the Maharashtra Public Trust Act. 3.

The respondent shall pass the orders in tune with proviso to Sub-section 2 of Section 22 of the Maharashtra Public Trust Act. The petitioner shall prosecute the said application and the Assistant Charity Commissioner shall decide it in accordance with law as per above referred provisions.

The writ petition is disposed of. No costs.
