IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 4 SECOND APPEAL NO. 590 OF 2005 NANDLAL RAMSAHAY AGRAWAL

VERSUS

OMPRAKASH NARAYAN AGRAWAL & ORS.

...

Advocate for Respondent No.1: C.R.Deshpande ...

WITH SECOND APPEAL NO. 591/2005 ...

CORAM : P.R. BORA, J.

Dated: June 18, 2018 ...

PER COURT :- 1.

In both these appeals previously Advocate Shri R.R.Mantri was appearing for the appellants. The record shows that learned Counsel Shri R.R.Mantri withdrew his appearance and the same was allowed on 8th February, 2017. The record further reveals that thereafter notices were issued at the Court motion to the legal representatives of deceased appellant, however, the notices of respondent nos.1B and 1D are returned unserved as the said persons are not residing on the given address. Appellant Nos.1C and 1E have refused to accept the notice on the ground that their names are not correctly mentioned.

2.

The matter is pending since last about one year for compliance. It seems that the legal representatives of deceased appellants have lost interest in prosecuting these appeals further. 3.

Both these appeals stand dismissed for want of prosecution.
