This application is filed for bail. Both the sides are heard. This Court has perused the papers of investigation. 2.
The crime is registered on the basis of report given by Namdeo who is resident of village Maski, Tahsil Loha. Deceased was his wife. Allegations are made that the applicant had evil eye on the deceased and he used to tease her when she was alone. On one occasion he held her and when she disclosed the incident to her husband and other relatives, the relatives had questioned the applicant and on that occasion he prayed for forgiveness and the matter was settled. Allegations are made that the applicant had again
-:(2):- started teasing the deceased and it was going on for about one month. On 4th January, 2015 at 08.30 to 09.00 p.m. the applicant virtually held her at a lonely place. When she shouted persons gathered and then the applicant ran away. She committed suicide on 5th January, 2015 by consuming poison. The report came to be given on 6th January, 2015 and the crime is registered for offence punishable under section 306 of I.P.C. This Court has gone through the statements recorded by police. Applicant has been behind bars for about two months. In view of the nature of allegations, this Court holds that it is not desirable to keep the applicant behind bars till disposal of the case. It is not certain as to how much time will be required for disposal of the case.

In the result, the application is allowed. The applicant is to be released bail on his furnishing P.R. and S. B. of Rs.50,000/- with one or more solvent sureties of like amount. He is not to tamper with the prosecution witnesses. He is not to commit similar offence. He is not to enter village Maski Tahsil Loha till the disposal of the case which may be filed against him.
