NAZIR USMAN SHAIKH AND ANOTHER ...

Advocate for Applicant : Mr. Pathan Hamzakhan I. Advocate for Respondents : Mr. U.R. Awate .....

CORAM : V. K. JADHAV, J.

DATED : 3rd MARCH, 2017 PER COURT:- 1.

Heard both sides.

2.

The appeal preferred by the other side came to be disposed of by this Court with direction that the claimants are entitled to withdraw the amount deposited by the appellant in proportionate, as awarded by the Tribunal. Learned counsel for the applicant submits that after disposal of said appeal, the applicant Saba has attained majority and therefore, she is entitled to withdraw the amount kept in F.D.R. in the nationalized bank in her name. Learned counsel has also produced on record the school leaving certificate of the applicant Saba. Considering the school leaving certificate, it appears that the applicant has now attained the majority. In view of above, the application is allowed in terms of prayer clause "B" and disposed of.
